Trademark infringement case filed in United States District Court, San Francisco. Defended the alleged infringer and asserted counter claims against the plaintiff. We obtained insurance coverage for our client’s defense costs and obtained a $250,000 net recovery to our client at settlement conference.

Represented the widow of a long time client in a wrongful death case involving a heart attack suffered in a neighbor’s swimming pool. Settled for defendant’s full insurance policy limits. San Joaquin County.

Slip and fall injury case against a restaurant franchisee involving a defective sidewalk at the defendant’s office premises. The case settled for $150,000 at mediation. San Joaquin County.

Defended an investment banking firm against debt collection claims for $2 Million brought by a major international bank on unpaid promissory notes. We developed lender liability counter claims against the bank for amounts in excess of the unpaid note balance and settled the case for mutual claim releases and zero cash paid by our client.

Supervised and managed an investment banking firm’s $50 million dollar equipment lease portfolio and coordinated the resolution of some two dozen distressed asset workouts within the client’s investment portfolio.

Represented an investor partner in connection with claims against its manager partner for breach of contract, breach of fiduciary duty, fraud, theft and conversion and usurpation of corporate opportunity resulting from defendant’s mishandling and self-dealing involving a multi-million dollar housing development project. We obtained preliminary injunctive relief and removed and replaced the defendant manager. Marin County.

Represented a large heavy equipment manufacturer in a trademark / trade dress infringement action filed in United States District Court, Sacramento. Secured temporary restraining order and preliminary injunction by stipulation with defendant. Case settled for cash payment to plaintiff and entry of a stipulated permanent injunction.

Prosecuted
promissory note collection claims against dozens of investors of
renewable power assets and filed claims against possessors of equipment pledged as collateral
in a portfolio of over 150 notes acquired by client. Obtained writ of possession after appeal and recovered the property. Case resulted in published opinion from Court of Appeal clarifying unsettled question regarding financing statements and security interests under the Uniform Commercial Code.
